Letterbatch Free Beta Terms
Effective date: October 16, 2026
1. About these terms
These terms cover the free Letterbatch beta provided by OFFBY5 LLC, an Illinois limited liability company doing business as Letterbatch ("Offby5," "we" or "us").
"You" means the person accepting for their own use or the organization they are authorized to represent. If you accept for an organization, you must have authority to bind it. Each person using the beta must be at least 18, have their own individually approved account and explicitly accept the terms before access. Each participant must follow the account, lawful-use, file-handling and review duties below. An organization's acceptance does not approve every colleague. A work email alone does not establish authority or create a personal guarantee.
We will keep a record of your account, acceptance date and the exact terms version you accepted. After each acceptance, we will email your account address a confirmation and a copy of the accepted terms you can keep. That email contains no promotions. The Privacy Policy explains our handling and retention of acceptance records.
Business and personal use are permitted, subject to applicable law. These terms do not promise availability or legal suitability in every country. Mandatory consumer rights and other rights that cannot lawfully be waived remain protected throughout these terms.
2. What the free beta provides
Letterbatch helps you combine existing documents, spreadsheets and other supported materials into prepared communications and downloadable packages. It is the last mile of preparation in your workflow. Preparing or downloading a package does not mean a communication has been sent, delivered or received through an external tool.
The beta is invite-only: you may request access, and approval is required. Approved access lasts while the beta runs unless you leave or access ends under section 10. Participation is free and requires no payment card. Any future paid access requires a separate offer stating its price, duration and any renewal terms, and your explicit opt-in before charging. The free beta will not automatically become paid access.
The beta is experimental. Features may change or be removed, and maintenance, testing or fixes may interrupt availability. We do not guarantee uptime, restoration times or a feature's inclusion in a future release. Feature changes do not bypass our beta-ending notice or authorize undisclosed changes in how information is handled.
3. Accounts and permitted use
During approved access, you may use Letterbatch for lawful personal or business work, including authorized client work, and share the outputs you lawfully create. Do not resell or sublicense application access, share login credentials or transfer your invitation. Each additional person needs their own approved account.
Take reasonable steps to protect your account and devices, keep credentials private and promptly report suspected unauthorized account access to [email protected] after becoming aware of it. You are not automatically liable for every action through a compromised account; our own security responsibilities remain.
Do not use Letterbatch for unlawful content or communications, infringement, abuse or exploitation, including abuse or exploitation of minors. Lawful records concerning minors are permitted. Do not bypass access or security controls, access others' accounts or systems without authorization, deliberately disrupt the service or introduce or distribute malware to compromise it or others. These restrictions preserve authorized testing and activities protected by law; they do not independently authorize security testing.
4. Your materials and outputs
You must have the rights, authority and lawful basis needed to use your files, data and communications, including required notices or permissions. You need not personally own every file, and consent is not the only possible lawful basis.
Take reasonable care with source data and instructions, including mappings and rules. Before sending, distributing or relying on an output, review recipient details, content and attachments. You decide what to send or rely on. These duties do not excuse Letterbatch-introduced errors: responsibility depends on the actual cause and each party's responsibilities, including shared causes.
You and other rights holders retain their rights in your inputs and outputs. Processing does not transfer ownership to Offby5 or create rights you did not have. Offby5 and its licensors retain their rights in Letterbatch's software, branding and technology, without acquiring your independent business methods or content.
Permission to process your working content is limited to performing the functions you request under the disclosed browser-local model. It does not authorize sale, advertising use, AI training or independent reuse for product improvement. The feedback permission below does not expand that permission.
5. Local storage, backups and privacy
Letterbatch is designed to process working files locally in your browser rather than upload them to our servers. Account, authentication, support and technical information are handled separately. Our Privacy Policy explains what Offby5 and its providers handle. Accepting these terms is not blanket consent for unrelated processing.
Saved work is designed to reopen from account-scoped browser storage while that storage remains available. Some features autosave; others require Save. Confirm saves before leaving. Unsaved changes and temporary recovery copies are not substitutes for successfully saved work.
Browser or device changes, site-data clearing, storage management and organization policies can remove or make saved work unavailable. Neither a request for persistent browser storage nor recovery features guarantee retention or recovery. Letterbatch is not a long-term hosted archive or managed backup service. These limits do not remove our responsibility for errors caused by Letterbatch or by changes we make to it.
Keep your source files, make the backups you need and download needed packages and outputs before access ends. Output packages and complete workspace backups serve different purposes; use the available backup/restore features when you need a separate copy of saved work. Keep sensitive copies appropriately protected and follow applicable organization policies. Local data remaining on a device does not guarantee later application access, compatibility or recovery. We do not promise download-only access after your access ends.
6. Support, security and special requirements
We provide beta support on a reasonable-efforts basis without a guaranteed response time. We will use reasonable efforts to investigate reported defects and fix them or offer a practical workaround where feasible. We do not guarantee every fix or a deadline. A fix or workaround may not undo harm already caused and does not remove other available remedies.
Use fictional or properly redacted support examples. Do not send or display protected health information (PHI) or other sensitive information in support files, screenshots or screen-sharing sessions. Redaction alone does not certify legal de-identification. If sensitive material arrives accidentally, we will restrict access, stop ordinary troubleshooting with it, request a suitable replacement and remove unnecessary copies as soon as reasonably practicable and lawful. Necessary legal or incident-investigation preservation remains restricted; instantaneous deletion from every provider backup is not promised.
Real business and personal files may be used locally, subject to applicable law and your requirements. This beta does not automatically include a Business Associate Agreement (BAA), compliance certification or special regulated-service commitment. Any legally required agreement with Offby5 must be reviewed and signed before the relevant use; we do not promise to accept every request. Duties imposed by law still apply.
We will use reasonable care in developing, maintaining and delivering Letterbatch, maintain reasonable safeguards for accounts and information we handle, and use reasonable efforts to assess and address relevant known or reported vulnerabilities. We do not guarantee perfect security, detection of every harmful file, continuous monitoring or fixed remediation deadlines.
Report security concerns to [email protected], initially without passwords, login codes or sensitive files. This contact does not establish testing authorization, a bug bounty, a safe harbor or round-the-clock monitoring. We will notify affected users without undue delay after becoming aware of a Letterbatch-related incident materially affecting their accounts or information, including compromised delivered software that may affect local files. We will communicate known impact, protective steps and relevant updates as information becomes available. Applicable law controls notification triggers, timing, recipients, content and delivery, including any lawful delay or withholding.
Letterbatch provides software, not legal, medical, tax, financial, regulatory or other professional advice. Examples and checks do not certify legal compliance or suitability. Obtain qualified advice where needed; our responsibility for Letterbatch's agreed functions and errors remains.
7. Feedback and public discussion
Provide reasonable feedback when requested while you participate. No positive review or fixed feedback quota is required. We may use your feedback and suggestions to improve Letterbatch without compensation, without gaining additional rights to your working files or protected information. Public use of your testimonial, name or logo needs separate permission.
You may discuss the beta and give honest reviews. There is no blanket nondisclosure agreement. Both parties must respect others' private and confidential information and rights. You owe no further participation or new feedback after leaving.
8. External tools and beta warranties
You are responsible for external tools you separately choose, including their accounts, licenses, fees and terms. Beta access does not include those tools or guarantee compatibility with every tool. We remain responsible under applicable law for our own acts, configuration and obligations, including components and providers we supply.
Subject to mandatory rights and our express commitments, the experimental beta is provided as is and as available. To the extent legally permitted, we disclaim implied warranties inconsistent with that offering. We do not promise uninterrupted or error-free operation or suitability for your particular task. Binding product representations and our support, security and notice commitments remain. We do not add a contractual promise to defend you or pay third-party intellectual-property claims; existing legal responsibilities and mandatory remedies remain.
9. Liability limits
Nothing here excludes or limits liability or remedies that applicable law does not allow us to exclude or limit, including applicable consumer protections and protection concerning fraud, intentional misconduct, death or personal injury where the law prohibits a limit.
To the extent legally permitted, Offby5 excludes liability for indirect or consequential losses. Lost profits, data loss or business interruption are not automatically indirect or excluded; the applicable law and circumstances determine that.
For claims that may lawfully be capped, Offby5's total aggregate liability to one contracting customer arising from the entire free beta is US$100. This is one total for covered claims, not a separate amount per incident, account or employee. It does not bind regulators or third parties who have not agreed to these terms. Review, backup and local-storage duties do not automatically release our own faults.
10. Leaving or ending access
You may leave at any time without penalty or required notice. Email [email protected] to request account closure or exercise privacy rights. Leaving, account closure and privacy requests are distinct; the Privacy Policy explains applicable cleanup, justified retained records and provider recovery copies. Neither closure nor cleanup promises remote erasure of local files.
We will give at least 14 days' notice by account email before a planned end to the beta. For non-urgent violations, we will give notice and a reasonable opportunity to fix the problem before suspending or ending access. We may restrict or end access sooner where reasonably necessary for urgent security or legal reasons, with notice as soon as reasonably possible when legally permitted. Maintenance or feature changes do not bypass planned ending notice.
Access ends when you leave, the beta ends or your access is suspended or terminated. Download what you need beforehand; no download-only grace period or later export access is promised. Account/profile cleanup follows our Privacy Policy, including when the beta ends unless you separately opt into continued service. A cleanup period does not extend access or guarantee later reinstatement, retention or recovery.
11. Changes and communications
For planned material terms changes, we will give at least 14 days' notice by account email, explaining the changes and effective date. Continued use under materially revised terms requires explicit acceptance of that version, which we will record. Silence or continued use alone is not acceptance. You may decline by stopping use before the effective date; save and download needed materials while you have access.
We may give shorter notice when a change is reasonably necessary for urgent legal or security reasons. We will give notice as soon as reasonably possible when legally permitted. Explicit acceptance remains required. Changes do not retroactively alter accrued claims or override signed commitments contrary to their terms or law. Additional legally required notices or consent still apply.
Formal notices go to your account email, subject to legally required methods. Promotional emails require a separate optional opt-in and easy unsubscribe; declining them does not affect beta access. Service notices and acceptance confirmations are separate. Waitlist permission covers its disclosed purpose, not unrelated promotions.
12. Governing law and disputes
Illinois law governs, preserving mandatory consumer protections and other non-waivable rights elsewhere. Disputes use courts, without mandatory arbitration. The default location is a state court in Cook County, Illinois, or the federal court serving Chicago if it has jurisdiction, subject to mandatory consumer and local-court rights.
These terms include no class-action waiver, advance jury-trial waiver or automatic loser-pays lawyer-fee obligation. Applicable court rules, lawful fee/cost awards, statutory remedies and sanctions remain.
Either party may propose a voluntary, good-faith attempt to resolve a dispute through [email protected] for up to 30 days. This is not a prerequisite to court, does not pause legal deadlines and does not restrict urgent relief, small claims or regulator complaints.
13. Other terms and contact
These accepted terms and clearly identified contractual addenda expressly agreed by the parties define the beta agreement. A separately negotiated agreement signed by Offby5 and you overrides these terms only where it expressly says so. No unidentified policies or future documents are incorporated wholesale. This preserves binding promises and pre-contract information, valid existing agreements, accrued claims, granted exceptions and responsibility for fraud or misleading statements. Privacy notices and legally required processing agreements keep their appropriate roles.
We may transfer this agreement with a sale of the relevant Letterbatch business or an Offby5 merger or acquisition involving it if the successor assumes the obligations and preserves user rights. We will give account-email notice and obtain legally required consent. Transfer does not release accrued liability or independently change content handling; material changes follow section 11.
Either party may be excused from an affected obligation only while and to the extent an event beyond its reasonable control actually prevents performance, was not reasonably foreseeable when agreeing, and could not reasonably be avoided or overcome. The affected party must limit disruption, notify promptly when reasonably possible and resume when feasible. This does not excuse its own fault or lack of precautions, accrued liability or mandatory duties, or bypass ending-access rules.
If a provision is unenforceable, the rest continues where it can lawfully and practically operate without it. This does not revive unfair terms or authorize unilateral replacement. Delayed enforcement or a one-time exception is not automatically a permanent waiver; we will honor actual extensions or exceptions granted. Intentional waivers should be explicit, written and limited to their scope; an authorized email may qualify where legally effective. Applicable reliance rules and statutory deadlines remain.
Ownership, appropriate privacy/confidentiality protections, existing feedback-use permission, lawful liability limits, disputes and accrued rights continue for their appropriate purposes after participation ends. Survival does not extend access, new feedback duties, content permissions, publicity rights, filing periods or lawful data retention.
